The law applies when a parent removes or retains (keeps) a child in defiance of court ordered custody and visitation arrangements. In more serious cases, the law applies when an abduction seems imminent or likely, such as when a parent has connections to another state or nation. The law applies when it appears likely the parent will run away with the child based on factors like abandoning employment, selling a house, closing a bank account or engaging in “unusual financial activities.” 

 

Courts will hear the facts in these cases quickly, even “the next judicial day.”
